Notice to Secretary of State and Maine Revenue Services
MCCS is required by the Opportunity Maine law to participate in certain calculations and certifications.
As regards the 20-A MRSA § 12542 (4)(B), MCCS certifies that an individual has “obtained the relevant degree” based upon MCCS’ own records of student attainment.
As regards the 20-A MRSA § 12542 (2)(A), MCCS certifies “whether or not the total principal of loans the individual received as part of that individual’s financial aid package exceeds the cost of in-state tuition and mandatory fees incurred in pursuit of the degree” based upon the contract and work sheet provided by the student. Because MCCS does not have independent knowledge of all loans that a student may receive and attempt to claim a credit for, MCCS relies upon the representations of the individual in completing those documents. MCCS does not independently verify the truth, accuracy, or completeness of any representation that the individual makes or omits from such representations.
Finally, as regards 20-A MRSA §12542 and/or 36 MRSA §5217-D, MCCS provides a standard work sheet for the individual to complete and, again, MCCS relies upon the individual to complete the form truthfully, accurately, and completely. MCCS does not certify whether the statutory criteria in 20-A MRSA §12542 (3)(E), 36 MRSA §5217-D(2), 36 MRSA §5217-D (4), or any other qualifying criteria are met, nor does MCCS certify the accuracy or appropriateness of the individual’s interpretations of the Opportunity Maine law in executing MCCS forms or in making representations to MCCS.
MCCS only certifies that its standard form is valid and that the individual has completed the form under oath.
